Terms and Conditions

Defining Aspects

The general terms and conditions will apply to all services provided by SC ENA FOTOVOLTAIC SRL through the website www.enafotovoltaic.com to the client and can only be modified with the express written agreement of SC ENA FOTOVOLTAIC SRL.

Thus, the following terms are defined as follows:

Client – a person, firm, company, or other legal entity requesting our services.

Provider – the commercial company SC ENA FOTOVOLTAIC SRL, headquartered in Brașov Municipality, Nicolae Labiș Street no. 36A, Brașov County, registered at the Trade Register: J08/1282/2021, CUI 44198806.

Services – any service, including the documents and services mentioned in the Order, to be performed for the Client by the Provider.

Order – a document that serves as a form of communication between the Provider and the Client through which the Client agrees to perform the Services and the Client agrees to receive these Services by paying their value.

Contract – an Order confirmed by the Client.

Intellectual Property Rights (IPR) – all intangible rights such as know-how, copyright and related rights, database rights, design rights, model rights, patents, trademarks, and domain name registrations for any of the above.

Specifications – all specifications and/or descriptions of the Services as specified in the Order.

Contractual Documents

By placing an electronic and telephone order on the website www.enafotovoltaic.com, the Client agrees with the form of communication (telephone or email) through which the Provider conducts its operations.

The Order will consist of the following documents, in order of importance:

  • The Order (together with clear mentions of details) and its specific conditions
  • The Client’s Specifications (where applicable)

If the Provider confirms the order, this will imply a complete acceptance of the terms of the Order. The acceptance of the order by the Provider is considered completed when there is a verbal (telephone) or electronic (email) confirmation from the Provider to the Client. An unconfirmed order is not considered at any time to have the value of a Contract. The general terms and conditions of execution will form the basis of the physically concluded Contract.

Extension of the Provider’s Obligations

The information presented on the provider’s website is informative. The Provider will use its professional knowledge to achieve the result stipulated in the Order and will perform the Services that meet the Client’s requirements, needs, and specifications.

Confidentiality

All documents and information of any nature provided to the Provider by the Client will remain the property of the Provider. They can only be used for the execution of the contract and can only be disclosed with the written consent of the Provider and after obtaining a confidentiality commitment from the recipient.

No public statement, promotion, press release, or any other form of disclosure to third parties will be made by the Client regarding the order without the prior written consent of the Provider.

Intellectual Property Rights

The Client understands the intellectual property rights and will not disclose to a third party or make public (on the internet or media) any of the information received from the Provider.

Also, the website name and graphic symbols are registered trademarks owned by SC ENA FOTOVOLTAIC SRL and cannot be taken, copied, or used without the written consent of the owner.

If the execution deadlines of the Order cannot be met, the Provider is obliged to inform the Client of the estimated completion date.

Force Majeure

Neither party will be liable for the non-performance of its contractual obligations if such non-performance is due to a force majeure event. Force majeure is an unpredictable event, beyond the control of the parties, and cannot be avoided (calamity, war, natural disaster).

Applicable Law

This contract is subject to the applicable legislation in force on the territory of Romania. Any disputes arising between the contractual parties will be resolved amicably. If this is not possible, the disputes will be resolved by the competent courts in Brasov.

Final Provisions and Miscellaneous

This section presents the terms of use of the services provided to you by www.enafotovoltaic.com. We reserve the right to modify these conditions whenever we deem necessary, without prior notice, which is why it is recommended to read these conditions each time you visit this site.

By simply accessing this site, you agree to these terms of use. If you do not agree with these terms, please stop using this site.

It is strictly forbidden to use or contact this online site for the purpose of disrupting or altering it, its content, or its security system, as well as to discredit or harass the rightful owner of the site and/or its clients or to discredit the services performed by it.
