SC ENA FOTOVOLTAIC SRL guarantees the security and confidentiality of data hosted and transmitted through communication information systems. This information may be used by SC ENA FOTOVOLTAIC SRL for issuing invoices, order confirmations, various special offers, promotions, etc. Website users can request the deletion of information from the database. Any request/notification for the deletion of information from the database will be sent by the person registered in the database via email to office@enafotovoltaic.com.

The merchant undertakes not to disclose personal data to third parties.

Due to the fact that personal data is transmitted electronically, SC ENA FOTOVOLTAIC SRL cannot be held responsible in any way for their loss or for the copying of information by unauthorized persons.

The information provided to SC ENA FOTOVOLTAIC SRL is used only for the purpose for which it was entered, in accordance with the laws in force.

SC ENA FOTOVOLTAIC SRL guarantees compliance with the rights conferred by Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data, by Law no. 365/2002 on electronic commerce, as well as by Ordinance no. 130/2000 on consumer protection in the conclusion and execution of distance contracts, with subsequent amendments.

According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and Law no. 102/2005 on the establishment and functioning of the National Supervisory Authority for Personal Data Processing, SC ENA FOTOVOLTAIC SRL, as a personal data operator, is obliged to manage safely and only for the specified purposes, the personal data provided by the client. We undertake that personal data will be:

  • processed in good faith and in accordance with legal provisions;
  • collected for specific, explicit, and legitimate purposes;
  • adequate, relevant, and not excessive in relation to the purpose for which they are collected and subsequently processed;
  • accurate and up-to-date; inaccurate or incomplete data in relation to the purpose for which they are collected and processed will be deleted or rectified;
  • stored in a form that allows the identification of the data subject strictly for the period necessary to achieve the purposes for which the data are collected and processed.

Processed data

Our company may process the following personal data:

  • name and surname
  • gender
  • phone/fax/email

Personal data processing is carried out only if the data subject has given their express and unequivocal consent for that processing.

Consent is not required in the following cases:

  • when processing is necessary for the execution of a contract or pre-contract to which the data subject is a party or for taking measures, at their request, before the conclusion of a contract or pre-contract;
  • when processing is necessary to protect the life, physical integrity, or health of the data subject or another threatened person;
  • when processing is necessary to fulfill a legal obligation of the operator;

The purpose of data collection is to fulfill the company’s object of activity, namely the provision of services.

The recorded information is intended for use by the operator and is communicated only to the following recipients, with the client’s consent: the data subject.

Guarantees

According to Law no. 677/2001, any data subject benefits from the right of access, the right to intervene on the data, the right not to be subject to an individual decision, and the right to address the courts. At the same time, the right to object to the processing of personal data concerning you and to request the deletion of data is guaranteed, except for data whose processing is mandatory, namely processing carried out by financial and fiscal services, police, justice, social security.

SC ENA FOTOVOLTAIC SRL, as a personal data operator, has the following information obligations:

If personal data is obtained directly from the data subject, except when this person already possesses the respective information, the operator will inform them of:

  • the identity of the operator and their representative, if applicable;
  • the purpose for which the data processing is carried out;
  • additional information, such as: the recipients or categories of recipients of the data; whether the provision of all requested data is mandatory and the consequences of refusing to provide them; the existence of the rights provided by this law for the data subject, especially the right of access, the right to intervene on the data, and the right to object, as well as the conditions under which they can be exercised;
  • any other information whose provision is imposed by a supervisory authority’s disposition, taking into account the specifics of the processing.

To exercise these rights, the data subjects can address our company with a written, dated, and signed request.

Right of access

Any data subject has the right to obtain from SC ENA FOTOVOLTAIC SRL, upon request and free of charge, the confirmation that the data concerning them are or are not being processed. SC ENA FOTOVOLTAIC SRL is obliged, if it processes personal data concerning the applicant, to communicate to them, together with the confirmation, at least the following:

  • information regarding the purposes of the processing, the categories of data considered, and the recipients or categories of recipients to whom the data are disclosed;
  • communication in an intelligible form of the data subject to processing, as well as any available information regarding the origin of the data;
  • information on the principles of operation of the mechanism by which any automatic data processing concerning the respective person is carried out;
  • information regarding the existence of the right to intervene on the data and the right to object, as well as the conditions under which they can be exercised;
  • information on the possibility of consulting the register of personal data processing, provided for in art. 24 of Law 677/2001, of submitting a complaint to the supervisory authority, as well as addressing the court to challenge the decisions of SC ENA FOTOVOLTAIC SRL, in accordance with the provisions of this law.

The data subject can request information from SC ENA FOTOVOLTAIC SRL through a written, dated, and signed request. In the request, the applicant can indicate whether they wish the information to be communicated to a specific address, which can also be an email address, or through a correspondence service that ensures delivery only to the applicant personally.

SC ENA FOTOVOLTAIC SRL is obliged to communicate the requested information within 15 days from the date of receipt of the request.

Right to intervene on the data

Any data subject has the right to obtain from SC ENA FOTOVOLTAIC SRL, upon request and free of charge:

  • rectification, updating, blocking, or deletion of data whose processing is not in accordance with this law, especially of incomplete or inaccurate data;
  • transformation into anonymous data of data whose processing is not in accordance with Law 677/2001

To intervene on the data, the data subject will submit to SC ENA FOTOVOLTAIC SRL a written, dated, and signed request. In the request, the applicant can indicate whether they wish the information to be communicated to a specific address, which can also be an email address, or through a correspondence service that ensures delivery only to the applicant personally.

SC ENA FOTOVOLTAIC SRL is obliged to communicate the measures regarding the data subject within 15 days from the date of receipt of the request.

Right to object

The data subject has the right to object at any time, for well-founded and legitimate reasons related to their particular situation, to the processing of data concerning them, except in cases where there are legal provisions to the contrary. In the case of justified opposition, the processing can no longer concern the data in question.

The data subject has the right to object at any time, free of charge and without any justification, to the processing of data concerning them for direct marketing purposes, on behalf of the operator or a third party, or to the disclosure of data to third parties for such purposes.

To exercise these rights, the data subject will submit to SC ENA FOTOVOLTAIC SRL a written, dated, and signed request. In the request, the applicant can indicate whether they wish the information to be communicated to a specific address, which can also be an email address, or through a correspondence service that ensures delivery only to the applicant personally.

SC ENA FOTOVOLTAIC SRL is obliged to communicate to the data subject the measures taken within 15 days from the date of receipt of the request, respecting the applicant’s possible option.

Termination of personal data processing operations

The processed data will be stored, according to art. 4 para. (1) lit. e) of Law no. 677/2001, for the duration necessary to achieve the purposes for which they were collected and subsequently processed.

Measures taken to ensure processing security

SC ENA FOTOVOLTAIC SRL takes all appropriate technical and organizational measures to protect personal data against accidental or illegal destruction, loss, modification, disclosure, or unauthorized access.
